SUBJECT Non-Veteran Spouses Remaining as Residents of Homes

PURPOSE

To establish the policy that a non-veteran spouses may remain as residents in a Veterans Home of California after the death of the resident veteran spouse.

POLICY

It shall be the policy of the Department of Veterans Affairs that:

1. A non-veteran spouse may remain as a resident of a Home as long as he or she desires unless any of the following conditions occurred prior to the veteran spouse’s death.
a. The veteran spouse was discharged from the Home for harassment of any kind to include verbal, physical or sexual harassment of either another member or employee of the Home.
b. The veteran spouse was discharged for violating the Home’s Code of Conduct.
c. The veteran spouse was discharged for being convicted of a misdemeanor or felony.
d. The veteran spouse and non-veteran spouse were in the process of a divorce.
e. The veteran spouse requested and was granted a voluntary discharge from the Home.
f. It is determined that the veteran spouse obtained admission to the Home by fraudulent means.
g. The veteran spouse was discharged from the Home for failure to pay required fees.

2. A non-veteran spouse resident of a Home is subject to the same rules and Code of
Conduct as residents or members of a Home and may be discharged for violations or
non-compliance.

3. In the event a veteran spouse, prior to death, is discharged from the Home because he or she abused the non-veteran spouse, the decision to allow the non-veteran spouse to remain in the Home will be decided on the circumstances and merits of the case with the best interests of the non-veteran spouse being considered.
